AmeriHealth Caritas Sr Legal Counsel- Employment in Newtown Square, Pennsylvania
Role Overview:
Reporting to the Associate Deputy General Counsel, this position will be primarily responsible for providing expert legal advice and guidance on a wide range of employment law and employee benefit matters, responding to administrative complaints and overseeing employment litigation matters.
This position acts as a trusted advisor to HR and leadership, delivering practical, risk-informed legal guidance that enables sound business decisions while ensuring compliance with employment and benefits laws.
Work Arrangement:
• Hybrid = Associate must be in the office at least three (3) days per week, including core days of Tuesdays and Wednesdays
Responsibilities:
Provide day-to-day legal counsel to HR and managers on a wide range of employment-related matters, including performance management, discipline, compensation, benefits, accommodations, leave management, terminations, separation, claims of discrimination/harassment/retaliation and wage and hour
Advise HR and business leaders on employee benefit and compensation matters, including plan design (including health and welfare, life, 401(k), STD/LTD, leave, severance and other related benefits programs), administration and regulatory compliance with ERISA, HIPAA, the Internal Revenue Code and ACA
Manage employment related administrative, state and federal litigation, including strategy development, case management, coordination without outside counsel and reporting to leadership
Partner with HR and other internal stakeholders to identify and mitigate risks and promote best practices in employment law compliance
Develop and review employment policies, procedures and handbooks to ensure legal compliance and alignment with best practices
Draft and review employment contracts, agreements and severance packages to ensure compliance with relevant laws and protect the company’s interests
Prepare range of documents for health and welfare plans, executive compensation and corporate compliance matters
Identify potential legal risks and provide proactive advice and solutions to prevent legal issues before they arise
Ensure compliance with labor and employment laws, government regulations, ERISA and internal policies
Operating with a high degree of integrity, in alignment with company mission and culture
Education/Experience:
Law Degree (JD) from accredited law school and active Bar membership in at least one state required
Actively licensed to practice law in at least one state, preferably Pennsylvania
Minimum of 10 years legal experience, including 5 years of employment and litigation experience in a law firm, in-house or government agency
Experience in health care or other highly regulated industry preferred
Other Skills:
Strong knowledge of Federal, State and Local employment laws, ERISA, and related regulations
Experience with pre-litigation disputes, including arbitrations and mediation
Experience managing outside counsel preferred
Strong ability to provide risk assessment/risk mitigation support and strong negotiation skills
Strong analytical, communication and problem-solving skills with the ability to provide clear and practical legal advice to non-lawyers
Ability to work both independently and collaboratively, provide leadership, influence organization behavior and create alignment across organizational lines
Excellent written and verbal communication skills, and the personal presence, credibility, and the professional demeanor necessary to interact with company management, regulatory bodies, and business units with persuasiveness and confidence
Collaborative team player with an ability to effectively manage competing priorities
Ready, willing and able to assist with new needs and comfortable with uncertainty and ambiguity
Excellent judgment and the ability to prioritize and make difficult decisions quickly
