Role Purpose
To be a member of a team responsible for:
• Executing trustee responsibility, ensuring alignment with fiduciary obligation and investor protection
• Overseeing and ensuring that client investment funds are operating in accordance with relevant rules and regulations as prescribed by the MPFA, SFC, HKMA Regulations and the constitutional documents of the funds.
• Acting independently as Trustee to review and monitor the reporting of incidents, breaches and non- compliance issues, and conduct direct regulatory reporting as required.
• Regularly monitoring the services of funds operators (including fund manager, internal and external service providers)
• Ensuring prompt and effective responses to inquiries from fund manager / operators / regulators, consulting internal stakeholders and risk stewards as appropriate
• Regularly reviewing and updating internal regulatory mapping files, delegation documentation, and internal procedures to maintain robust governance frameworks
• Monitoring the regulatory update and assessing their impact on trustee operations and implement necessary changes to ensure ongoing compliance
• The role is relationship driven and will involve conversation with clients.
Principal Accountabilities:
• Implementing oversight strategies to ensure investment funds operate in accordance with the MPFA, SFC, HKMA regulations and constitutional documents of the funds
• Ensuring operations procedure is effectively followed.
• Act as a link between the team and other stakeholders to ensure business is conducted appropriately, ensuring a high standard of Trustee service is provided
• Regularly review and update internal regulatory mapping files, delegation documentation, and internal procedures to maintain robust governance frameworks
• Act as one of the principal points of contact for trustee clients in relation to regulatory developments and client queries
• Escalate and consult senior manager, legal and compliance for assistance if needed.
Requirements:
• The role can be performed only by a Licensed Representative licensed for SFC Regulated Activity Type 13 (i.e. RA13 license). If not already licensed as such, the role holder must be capable of fulfilling the licensing conditions relevant to RA13 including passing the relevant examination/s and having the relevant professional qualifications and/or industry experience.
• Appropriate trustee or funds experience.
• A good appreciation of the Hong Kong fund regulatory environment and detailed knowledge of regulatory developments
• Appropriate technical knowledge to deal with legal, accounting and technical issues arising in relation to servicing of funds
• Ability to analyse complex fund operations issue with a focus on fiduciary duty and propose solutions
• Appropriate technical knowledge to deal with legal, accounting and technical issues arising in relation to the management of funds
• First rate communication and presentational skills
• High degree of computer literacy
• Excellent numeric and analytical skills with strong attention to detail
• Experience and confidence in dealing with clients at a senior level
• Demonstrate management and coaching skills
• Strong team working ability; open to new ideas and confident in sharing thoughts and proposals in team discussion
• Clear understanding of importance of effective customer service internally and externally.
• Ability to cultivate strategic client relationships and ensuring clients’ perspective is the driving force behind all value-added business activities.
• University degree or equivalent work experience.
