Role Purpose

A senior member of the Funds Oversight team, responsible for Investment Restriction Monitoring (IRM) and Oversight of Collective Investment Scheme Operators (CIS Oversight).

Principal Accountabilities:

The role will manage and develop the IRM team which is responsible for:

• Ensuring the clients are operating in accordance with relevant investment objectives, rules and restrictions on the constitutional documents and investment management agreement of the fund. This can include funds where HSBC has a fiduciary obligation or contractual obligation.

• Analyzing the rules and regulatory requirements that are needed to be setup in the system in the IRM or any other relevant systems

• Investigate the alerts, warning, and potential breaches that are escalated by the operational teams

• Conducting cash flow monitoring and verification of non custodizable assets of funds

• Provide framework and executing the governance of the offshore operations

• Acting independently on monitoring and reporting breaches of the restrictions to clients

• Ensuring client SLA are met and agreed procedures followed

• The role is relationship driven and will involve conversation with clients

• Supporting RFPs, representing the trustee in RFP and client DD meetings

The role will additionally support the CIS Oversight team which is responsible for:

• Executing trustee responsibility, ensuring alignment with fiduciary obligation and investor protection

• Overseeing and ensuring the investment funds are operating in accordance with relevant rules and regulations as prescribed by the MPFA, SFC, HKMA Regulations and the constitutional documents of the funds

• Acting independently as Trustee to review, monitor the reporting or report the incidents. breaches and non- compliance issue to regulator

• Regularly monitoring the service of funds operators (including fund manager, internal and external service providers)

• Monitoring regulatory updates and assessing their impact on trustee operations and implementing necessary changes to ensure ongoing compliance.

Requirements:

• The role can be performed only by a Licensed Representative licensed for SFC Regulated Activity Type 13 (i.e. RA13 license). If not already licensed as such, the role holder must be capable of fulfilling the licensing conditions relevant to RA13 including passing the relevant examination/s and having the relevant professional qualifications and/or industry experience.

• Appropriate Trustee or Funds experience, with solid experience at managerial level.

• Solid understanding of financial instruments, stock markets and derivatives.

• A good appreciation of the Hong Kong funds regulatory environment and detailed knowledge of regulatory developments

• Appropriate technical knowledge to deal with legal, accounting and technical issues arising in relation to the oversight of fund operations

• First rate communication and presentation skills

• High degree of computer literacy, supported by numeric and analytical skills with strong attention to detail

• Experience and confidence in dealing with clients at a senior level

• Demonstrate management and coaching skills

• Strong team working ability and capable of encouraging ideas and input from team members.
