The Sr Real Estate Litigation Attorney serves as a senior subject matter expert supporting real estate and construction‑related disputes across the enterprise, including retail locations, distribution centers, gas stations, and other company locations.
This role provides legal leadership and executional oversight for real estate litigation matters within an established legal and risk framework. The Senior Manager partners closely with business and legal leadership to support litigation readiness, risk mitigation efforts, and internal education initiatives related to real estate and construction disputes.
The role operates with a high degree of independence within a defined scope, applying advanced legal judgment while collaborating with senior leaders to manage litigation risk and support dispute‑avoidance initiatives across the portfolio.
Key Responsibilities
Manage and oversee complex and high‑exposure real estate and construction disputes, including landlord/tenant matters (notices of default, lease enforcement and interpretation, rent and CAM disputes, and repair and maintenance matters) and construction disputes (defect claims, delay and scheduling disputes, payment disputes, mechanic’s lien matters, contractor performance issues, and warranty claims).
Support and implement contract revisions, process improvements, and policy enhancements designed to strengthen risk allocation, indemnity structures, insurance provisions, and dispute‑resolution mechanisms.
Contribute to the development and maintenance of litigation playbooks, best‑practice guidance, and training programs for cross‑functional stakeholders.
Manage and coordinate outside litigation counsel across multiple jurisdictions, including early case assessment, budgeting and accrual forecasting, pleadings, discovery and ESI strategy, motion practice, mediation, arbitration, and trial preparation; oversee litigation holds and internal discovery coordination as appropriate.
Oversee and manage a range of real estate litigation matters, including title disputes, easement and access issues, condemnation matters, bankruptcy‑related real estate issues, environmental claims, and property damage claims.
Draft and respond to demand letters, default notices, reservation of rights letters, settlement agreements, and related dispute correspondence.
Partner with Risk Management and insurance carriers to support claims strategy, address coverage questions, and assist with recovery efforts as needed.
Job Requirements
Bachelor’s degree and J.D. from an accredited law school.
Active license and good standing in at least one U.S. jurisdiction.
8+ years of experience in commercial real estate litigation, construction disputes, or closely related practice areas.
Demonstrated advanced knowledge of commercial leases, construction agreements, and real estate‑related disputes.
Proven ability to independently manage complex matters, collaborate with senior stakeholders, and align legal advice with business objectives.
Experience managing high‑value matters with outside counsel, including budget oversight and performance management.
Strong judgment, negotiation, and communication skills with the ability to provide practical, business‑oriented legal guidance.
Collaborative, team‑oriented leader capable of managing multiple priorities and operating effectively with minimal supervision.
This is a hybrid role. Tuesday through Thursday are in-office days at BJ's Club Support Center in Marlborough, MA and Monday and Friday are remote days.
In accordance with the Pay Transparency requirements, the following represents a good faith estimate of the compensation range for this position. At BJ’s Wholesale Club, we carefully consider a wide range of non-discriminatory factors when determining salary. Actual salaries will vary depending on factors including but not limited to location, education, experience, and qualifications. The pay range for this position is $175,000.00 - $220,000.00
